Terms of Service

Please read these terms carefully before using giveeit. They define your rights and obligations as a donor and user of our platform, and reflect our commitment to operating transparently and ethically.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Donor", or "you") and giveeit Foundation ("giveeit", "we", "our", or "us"), a not-for-profit company incorporated under Section 8 of the Companies Act, 2013, bearing CIN U85100DL2020NPL123456.

By accessing our website at giveeit.in, creating an account, making a donation, subscribing to a recurring giving plan, or using any feature of our platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not accept these Terms in their entirety, you must immediately discontinue use of the platform.

These Terms apply to all users of giveeit β€” donors, visitors, campaign beneficiaries, NGO partners, and any third party who accesses our platform. Where separate agreements exist for NGO partners or institutional donors, those agreements supplement (but do not replace) these Terms.

If you are accepting these Terms on behalf of an organisation, you warrant that you have the authority to bind that organisation, and "you" refers to that organisation throughout these Terms.

2. Eligibility & User Accounts

To use the donation features of our platform, you must be at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872. Persons below 18 may browse the platform but may not donate, create accounts, or set up recurring subscriptions independently β€” such actions require the consent and supervision of a legal guardian.

Account Registration

  • You must provide accurate, current, and complete information during registration. Providing false, misleading, or incomplete information is a violation of these Terms and may result in immediate account suspension.
  • You are solely responsible for maintaining the confidentiality of your login credentials. giveeit will never ask for your password via email, chat, or phone.
  • Any activity conducted through your account β€” including donations, subscription changes, and profile updates β€” is your responsibility, whether or not authorised by you.
  • You must notify us immediately at support@giveeit.in if you suspect unauthorised access to your account.
  • We reserve the right to refuse registration or suspend accounts at our sole discretion if we have reasonable grounds to believe that Terms have been violated.

One individual may not maintain multiple donor accounts. Duplicate accounts are detected and merged or suspended without prior notice. If you wish to manage donations on behalf of a family member, please use the "Donate on behalf of" feature available at checkout.

3. Donations, Payments & Financial Terms

All donations made through giveeit are voluntary contributions. By confirming a donation, you acknowledge that the transaction is a charitable gift and not a commercial purchase. Donations are non-transferable and cannot be exchanged for goods, services, or monetary value outside the scope of these Terms.

3.1 Payment Processing

All payments are processed through Razorpay Payment Solutions Private Limited, a PCI-DSS Level 1 certified payment gateway regulated by the Reserve Bank of India. giveeit does not store, process, or transmit your payment card information. By making a payment, you also agree to Razorpay's Terms of Service and Privacy Policy.

3.2 Currency & Charges

  • All domestic transactions are denominated in Indian Rupees (INR). International donors are charged in INR; currency conversion is handled by your card issuer or bank at their prevailing exchange rate.
  • giveeit charges zero platform fee on donations. The amount you enter at checkout is the exact amount credited to the campaign. Optional "tips" to support giveeit operations are clearly presented and entirely voluntary.
  • Applicable GST, TDS, or other statutory levies β€” if any β€” are borne by giveeit and are not passed on to donors.
  • For international donations via FCRA channels, your bank may apply foreign transaction fees as per their fee schedule. These are outside giveeit's control.

3.3 Fund Disbursement

Donations are held in a dedicated escrow-style account and disbursed to the relevant NGO partner within 5 working days of the campaign reaching its minimum funding threshold. In the event a campaign is overfunded beyond its stated goal, surplus funds are applied to the next phase of the same programme or a closely related programme run by the same NGO partner, with a public notice posted on the campaign page.

3.4 80G Tax Certificates

giveeit is certified under Section 80G of the Income Tax Act, 1961. Donors who provide a valid PAN number are entitled to receive an 80G certificate, which allows them to claim a 50% deduction on the donated amount from their taxable income. Certificates are issued within 7 working days for one-time donations, and annually every April for recurring (subscription) donors. giveeit does not provide tax advice; consult a qualified tax professional for guidance on your specific circumstances.

4. Recurring Donations & Subscriptions

By setting up a recurring donation ("Subscription"), you authorise giveeit and its payment partner, Razorpay, to automatically charge your selected payment method on the agreed frequency (Monthly or Yearly) until you cancel. This authorisation remains valid until explicitly revoked.

Your rights as a subscriber:

  • Cancel at any time with immediate effect β€” no minimum commitment, no cancellation fee, no penalty.
  • Pause your subscription for up to 3 consecutive months without losing your donor history or 80G records.
  • Change the campaign your subscription funds from your Dashboard at any time.
  • Receive a written confirmation (via email) of any change to your subscription within 24 hours.

Our obligations as the subscription operator:

  • We will notify you by email at least 5 days before any change to the recurring amount or billing date.
  • We will attempt failed payments no more than twice before pausing the subscription and notifying you.
  • We will never increase your subscription amount without your explicit re-consent.
  • We will provide an annual summary of all charges and the associated 80G certificate by April 30 each year.

Cancellation of a subscription does not affect donations already processed. Those remain valid charitable contributions and retain their 80G eligibility.

5. Refund & Cancellation Policy

Because donations are charitable gifts, refunds are granted only in specific, well-defined circumstances. Voluntary refund requests made after a successful payment and disbursement are not entertained, as the funds will have been committed to programme delivery.

Refunds are available in the following situations:

  • Technical double-charge: If your account is charged more than once for a single transaction due to a technical error, the duplicate charge is refunded in full within 5 working days of the error being confirmed.
  • Campaign cancellation: If a campaign is withdrawn by giveeit before funds are disbursed (e.g., the NGO partner fails re-verification), all donations to that campaign are refunded in full.
  • Below-threshold closure: If a campaign closes having raised less than its minimum funding threshold (30% of goal), all donors are refunded in full.
  • FCRA rejection: If an international donation is rejected by the banking system or regulatory authority, it is returned to the originating account in full.

Refund Process:

To request a refund in an eligible situation, email support@giveeit.in within 30 days of the transaction with your transaction ID and reason. Approved refunds are processed to the original payment method within 5–7 working days. Refund timelines for credit cards and UPI depend on your bank or payment provider. Once an 80G certificate has been issued for a donation, a corresponding cancellation notice is sent to your email if that donation is subsequently refunded.

6. Campaigns & NGO Partner Obligations

giveeit acts as a technology-enabled fundraising facilitator, not as a direct implementer of programmes. All campaigns are run by independent NGO partners who have been vetted by our team. By fundraising through giveeit, NGO partners agree to a separate Partner Agreement that includes the following obligations:

  • Maintaining valid 12A, 80G, and (where applicable) FCRA registrations at all times.
  • Providing audited financials and programme reports on a quarterly basis.
  • Publishing at least one substantive campaign update per month during active fundraising.
  • Using disbursed funds exclusively for the stated programme purpose.
  • Responding to donor queries routed through giveeit within 48 hours.
  • Notifying giveeit immediately of any material adverse event β€” regulatory action, leadership change, or programme disruption.

While giveeit conducts rigorous due diligence, we do not guarantee the outcomes of any specific programme or campaign. Impact figures stated on campaign pages are targets set by the NGO partner based on their operational experience. Actual outcomes may vary due to factors outside our control.

giveeit reserves the right to suspend or delist any campaign at any time if it determines, in its sole discretion, that the NGO partner has violated its obligations, misused funds, or engaged in conduct inconsistent with giveeit's values.

7. User Conduct & Prohibited Activities

You agree to use giveeit solely for its intended purpose β€” to support verified charitable campaigns β€” and in compliance with all applicable laws. The following activities are strictly prohibited:

  • Using the platform for money laundering, tax evasion, or financing any unlawful activity.
  • Making donations using stolen, fraudulent, or unauthorised payment instruments.
  • Creating fake accounts, impersonating another person or organisation, or misrepresenting your identity.
  • Using automated tools (bots, scrapers, crawlers) to access, collect data from, or interfere with the platform.
  • Attempting to reverse-engineer, decompile, or exploit any part of the giveeit technology stack.
  • Transmitting spam, phishing links, or unsolicited commercial communications through any giveeit communication channel.
  • Posting false, defamatory, or misleading information about any campaign, NGO, beneficiary, or giveeit employee.
  • Circumventing or attempting to circumvent any security, authentication, or access control feature of the platform.
  • Facilitating or encouraging any of the above by a third party.

Violation of these prohibitions may result in immediate account suspension, reversal of transactions, reporting to law enforcement authorities, and civil or criminal legal action. We reserve the right to cooperate fully with any government authority investigating any of the above activities.

8. Intellectual Property

All content on the giveeit platform β€” including but not limited to the logo, brand name, website design, user interface, illustrations, campaign photographs, impact reports, written copy, and software code β€” is the exclusive intellectual property of giveeit Foundation or is used under licence from rightful owners. It is protected by the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international intellectual property treaties.

What you may do:

  • Share campaign pages and donation links on social media for the purpose of fundraising.
  • Download and use your own donation receipts and 80G certificates for personal tax filing.
  • Quote short excerpts from our platform (with attribution) for journalistic or educational purposes.

What you may not do:

  • Reproduce, republish, or commercially exploit any giveeit content without prior written permission.
  • Use the giveeit name, logo, or brand assets in a manner that implies endorsement or partnership.
  • Remove or alter any copyright, trademark, or attribution notice from any content downloaded from our platform.
  • Create derivative works based on our platform design or branding without written consent.

To request permission for use beyond the above, write to legal@giveeit.in with a description of the intended use. We respond to such requests within 10 working days.

9. Privacy & Data Protection

Your privacy is a fundamental right, and we take our obligations under the Digital Personal Data Protection Act, 2023 (DPDP Act) seriously. Our collection, use, storage, and disclosure of your personal data is governed exclusively by our Privacy Policy, which is incorporated into these Terms by reference and forms an integral part of the agreement between you and giveeit.

By using the platform, you consent to the processing of your personal data as described in our Privacy Policy. Key highlights: we do not sell your data; donor PAN and financial records are retained for 8 years as required by Indian tax law; you may request access, correction, or deletion of your data at any time by writing to privacy@giveeit.in.

Campaign pages may display donor names and donation amounts as social proof (e.g., "Rahul S. donated β‚Ή1,000"). If you prefer anonymity, select "Donate Anonymously" at checkout β€” your name will be replaced with "Anonymous Donor" on all public-facing displays.

10. Disclaimers & Limitation of Liability

10.1 Platform Availability

giveeit provides the platform on an "as is" and "as available" basis. We make no warranty β€” express, implied, or statutory β€” that the platform will be uninterrupted, error-free, virus-free, or free from technical defects. We will make reasonable efforts to maintain uptime of 99.5% on a monthly basis, but do not guarantee this as a contractual obligation.

10.2 Programme Outcomes

giveeit does not guarantee the specific impact, outcome, or result of any campaign or NGO programme. While we vet our partners rigorously, factors including natural disasters, regulatory changes, operational challenges, and economic conditions may affect programme delivery. We are not liable for any failure to achieve stated impact targets.

10.3 Limitation of Liability

To the fullest extent permitted by applicable law, giveeit, its directors, officers, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages β€” including but not limited to loss of data, loss of goodwill, financial loss beyond the donated amount, or loss of opportunity β€” arising from your use of (or inability to use) the platform.

In all cases, giveeit's aggregate liability to any individual user shall not exceed the total amount donated by that user in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless giveeit Foundation, its parent entities, subsidiaries, directors, trustees, officers, employees, consultants, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

  • Your violation of any provision of these Terms.
  • Your breach of any applicable law, regulation, or third-party right (including intellectual property rights).
  • Any false or misleading information provided by you during registration, donation, or any interaction with the platform.
  • Any claim brought by a third party resulting from your use of the platform.
  • Your infringement of another user's rights through your conduct on the platform.

giveeit reserves the right to assume exclusive control of the defence of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defence efforts and not to settle any such matter without our prior written consent.

12. Suspension & Termination

giveeit reserves the right to suspend, restrict, or permanently terminate your access to the platform β€” with or without prior notice β€” if we determine, in our sole and reasonable discretion, that:

  • You have violated any provision of these Terms.
  • Your account has been used for fraudulent, illegal, or deceptive activity.
  • Continued access poses a risk to the security, integrity, or reputation of the platform or its users.
  • A competent legal authority has directed us to restrict or terminate your access.
  • You have provided false information that materially affects your eligibility to use the platform.

Upon termination: your right to access the platform ceases immediately; any pending donations in transit are completed or refunded at our discretion; your account data is handled in accordance with our Privacy Policy and applicable data retention laws.

You may voluntarily close your account at any time by emailing support@giveeit.in. Voluntary closure does not affect the validity of donations made prior to closure, and relevant tax records are retained as required by law.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles. The parties specifically exclude the application of the United Nations Convention on Contracts for the International Sale of Goods.

Step 1 β€” Informal Resolution (Mandatory First Step)

Before initiating any formal dispute resolution process, you must contact our Grievance Officer at legal@giveeit.in with a clear description of the issue. We will acknowledge your complaint within 3 business days and endeavour to resolve it within 30 days through good-faith discussion.

Step 2 β€” Arbitration

If a dispute cannot be resolved informally, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, or appointed by the Delhi High Court in the absence of agreement. The seat and venue of arbitration shall be New Delhi. The language of arbitration shall be English.

Step 3 β€” Courts

Only for matters not suitable for arbitration (such as injunctions or intellectual property claims), the courts of New Delhi, India shall have exclusive jurisdiction. You waive any objection to such jurisdiction.

Nothing in this clause prevents either party from seeking urgent interim or injunctive relief from a competent court to protect its rights pending arbitration.

14. Modifications to These Terms

giveeit reserves the right to update, revise, or replace any part of these Terms at any time to reflect changes in law, platform functionality, business practices, or regulatory requirements. All changes are effective from the date stated in the updated Terms.

When we make material changes, we will: (1) post the revised Terms on this page with an updated "Last Updated" date; (2) send an email notification to all registered users at least 14 days before the effective date; and (3) display a prominent notice on the platform during the notice period.

Your continued use of giveeit after the effective date of any revision constitutes your acceptance of the updated Terms. If you object to any change, your sole remedy is to discontinue use of the platform and close your account. We recommend bookmarking this page and reviewing it periodically.

15. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy and any other policies linked herein, constitute the entire agreement between you and giveeit with respect to your use of the platform, and supersede all prior agreements, representations, or understandings.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect, and the unenforceable provision shall be replaced with a valid provision that most closely reflects the original intent.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver is effective only if made in writing and signed by an authorised representative of giveeit.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. giveeit may freely assign its rights and obligations β€” including in connection with a merger, acquisition, or sale of assets β€” provided that the successor entity agrees to honour all existing user commitments under these Terms.

Force Majeure

giveeit shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control β€” including but not limited to natural disasters, acts of government, war, pandemic, cyberattacks, power failures, or internet disruptions. We will make reasonable efforts to minimise disruption and notify affected users promptly.
